This is a legal contract between You and GreensburgNeighbors.Com, owned and directed by My City My State, LLC. Greensburgneighbors.com realizes You may find this information long and boring, but must nevertheless, request Your complete agreement with all the following "Terms and Conditions" before using any of the site features. Please continue reading and if You do not agree with any part, Greensburgneighbors.com, requests that You do not continue to use the site.

By using any site feature You hereby agree to be bound by the following "Terms and Conditions".

DEFINITIONS:

1. "Website" - GreensburgNeighbors.Com
2. "You(r)" or "User" - Any person, entity, program or device using this Website.
3. "Advertisement" - Paid content space posted on GREENSBURGNEIGHBORS.COM or a Family site.

5. "Contract" - An agreed transaction between You and GREENSBURGNEIGHBORS.COM.
6. "Username" - A nickname You create for the use of GREENSBURGNEIGHBORS.COM or Family Sites. Full names are required as usernames.
7. "Bonehead(s)" -The name given to any User that has intentionally and/or willfully attempted to misuse GREENSBURGNEIGHBORS.COM or a Family Site.
8. "Banned Material" - Content failing to meet these Terms and Conditions.
9. "Upload" - Placing file on this Website not from another computer or device.
10. "User Content" -Text or graphics placed on the Website by a User.
11. "Account(s)" - Each unique "Username and Password."

TERMS AND CONDITIONS:

(1.) Age requirement. You represent that You are at least thirteen(13) years of age or more, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms and Conditions, and to abide by and comply with these Terms and Conditions. All users who are 18 years of age and younger are required to have their parents fill out a COPPA form found on the registration page.

(2.) Accounts. In order to access some features of the Website, You will have to create an account. When creating an account, You agree to provide accurate and complete information. You are solely responsible for the activity that occurs on Your account, and You agree to keep Your account password secure. You agree to notify GREENSBURGNEIGHBORS.COM immediately of any breach of security or unauthorized use of Your account. Although GREENSBURGNEIGHBORS.COM will not be liable for Your losses caused by any unauthorized use of Your account, You may be liable for the losses of GREENSBURGNEIGHBORS.COM or others due to such unauthorized use. You may never use another User's account without permission.

In connection with User Content, You agree not to: (i) submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless You are the owner of such rights or have permission from their rightful owner to post the material and to grant GREENSBURGNEIGHBORS.COM all of the license rights granted herein; (ii) publish falsehoods or misrepresentations that could damage GREENSBURGNEIGHBORS.COM or any third party; (iii) submit material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate; (iv) impersonate another person; (v) claim to be a representative of GREENSBURGNEIGHBORS.COM. GREENSBURGNEIGHBORS.COM does not endorse any User Content or any opinion, recommendation, or advice expressed therein, and GREENSBURGNEIGHBORS.COM expressly disclaims any and all liability in connection with User Content. GREENSBURGNEIGHBORS.COM does not permit copyright infringing activities and infringement of intellectual property rights on its Website, and GREENSBURGNEIGHBORS.COM will remove all User Content if properly notified that such content infringes on another's intellectual property rights. GREENSBURGNEIGHBORS.COM may remove any such User Content and/or terminate a User's access for uploading prohibited material under these Terms and Conditions at any time, without prior notice and at its sole discretion.

(4.) You and Third Parties. You agree that GREENSBURGNEIGHBORS.COM is not responsible and does not monitor any transaction between You and any Third Party.

(5.) User Content Exposure. You understand that when using the GREENSBURGNEIGHBORS.COM Website, You will be exposed to User Content from a variety of sources, and that GREENSBURGNEIGHBORS.COM is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Content. (7.) Gathering Information Prohibited. (8.) Use of Content. You agree that GREENSBURGNEIGHBORS.COM may use Your classified, advertisement, name and logo in presentations, marketing materials, customer lists, financial reports, an Web site listings of customers, Search Results Pages, and Referral Pages. If You wish to use GREENSBURGNEIGHBORS.COM 's trade names, trademarks, service marks, logos, domain names, and other distinctive brand features, You may do so, so long as such use is in compliance with these Terms and Conditions.

(9.) Shared Information. You agree that GREENSBURGNEIGHBORS.COM may share non-personally-identifiable information about You, including Site URLs, Site-specific statistics and similar information collected by GREENSBURGNEIGHBORS.COM, with advertisers, business partners, and other third parties.

(10.) Gathering Source Prohibited. You will not modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble or otherwise attempt to derive source code from GREENSBURGNEIGHBORS.COM and/or Family Sites, services, or documentation, or create or attempt to create a substitute or similar service or product through use of or access to the Website or proprietary information related thereto.

(11.) Email from the Site Director. You agree to accept email communication from the following email addresses; brack@greensburgneighbors.com including subjects not limited to Rate Card changes, changes to Terms and Conditions, marketing, etc.

(12.) Unsolicited Communications. You agree that GREENSBURGNEIGHBORS.COM will not be held responsible for communications You receive as a result of Your use of the Website.

(13.) Multiple accounts. You agree not to create multiple Accounts. You are allowed one(1) personal account for creating content, one(1) non-profit account and one(1) business account for each entity You represent for creating content. Creating multiple accounts will be subject to immediate termination unless expressly authorized in writing by GREENSBURGNEIGHBORS.COM,(including by electronic mail).

(14.) Credits. You agree that GREENSBURGNEIGHBORS.COM shall be under no liability or responsibility to monetarily credit You with any amount for Content space You have purchased.

(15.) Force Majeure. You agree to indemnify, defend and hold GREENSBURGNEIGHBORS.COM, its Moderator, owners, operators, officers, employees, affiliates, and/or licensors harmless from and against any and all reductions in site traffic or other distribution caused by, including but not limited to, acts of God, power failures, strikes, labor disputes, suspension of publication, governmental action, act of terrorism, failure of transmission or any other cause beyond the control of GREENSBURGNEIGHBORS.COM.

(16.) Position. You agree to have Your advertisement or classified positioned in accordance with the source code set by GREENSBURGNEIGHBORS.COM. Under no circumstance will adjustments, edits, reinstatements or refunds be made because of the position and/or category in which an advertisement has been posted.

(17.) Errors in User Content. You agree to thoroughly review and make appropriate edits to Your Content or Advertisement including but not limited to title, body, contact information and search text, before submitting. You expressly relieve GREENSBURGNEIGHBORS.COM from any and all responsibility arising from any errors appearing in advertisements posted by You or a Third Party you designate.

(18.) Participation. You agree that GREENSBURGNEIGHBORS.COM reserves the right to refuse participation to any applicant or participant at any time in its sole discretion. GREENSBURGNEIGHBORS.COM reserves the right to erase any User Content or Advertisement, deemed by the Site Director, to be in non-compliance or violation of these Terms and Conditions.

(19.) Other applicable laws. You accept each federal, state, and local jurisdiction may have applicable laws regarding the publishing of information on the internet. It is Your responsibility to review and follow all such laws and You hereby relieve GREENSBURGNEIGHBORS.COM from any responsibility to inform You of those laws.

(20.) Necessary Funds. You agree that You have the necessary funds or credit to purchase Advertising Space before You submit an Advertisement.

(21.) Language. You agree to accept information provided to You for the purpose of using this Website including but not limited to; Terms and Conditions, Privacy and Security, Payment information, to be provided in English.

(22.) Assigning Rights. You agree that GREENSBURGNEIGHBORS.COM may assign this Contract to any affiliate at any time without notice. The relationship between GREENSBURGNEIGHBORS.COM and You is not one of a legal partnership relationship, but is one of independent contractors.

(23.) Payment forms. You agree to use the following forms of payment when purchasing Advertising Space; credit cards - Visa, MasterCard, Discover Network, American Express through Paypal. Checks and Cash are acceptable as well. Payments are made prior to the posting of any Advertisement or Ad campaign.

(24.) Privacy and Security. You agree and understand that it is necessary for GREENSBURGNEIGHBORS.COM to collect, process and use personal data in order to perform this contract. GREENSBURGNEIGHBORS.COM will protect User information in accordance with GREENSBURGNEIGHBORS.COM Privacy Policy. Click on the "Privacy and Security" link available at all Family Sites.

(25.) Diagnosing an Issue. You agree to cooperate with and follow instructions provided by GREENSBURGNEIGHBORS.COM, including but not limited to providing all documentation and assistance necessary to demonstrate and allow GREENSBURGNEIGHBORS.COM to diagnose an issue. You shall be solely responsible for any and all restoration and reconstruction of lost or altered files, data, or programs. You will maintain and implement a complete data backup and disaster recovery plan. You shall be solely responsible for any and all security of its confidential, proprietary and/or classified information.

(27.) Waiver. You agree that the waiver of any breach or default under these Terms and Conditions shall not constitute a waiver of any subsequent breach or default. If a court of competent jurisdiction holds that any provision of these Terms and Conditions is invalid or unenforceable, the remaining portions will remain in full force and effect, and the parties will replace the invalid or unenforceable provision with a valid and enforceable provision that achieves the original intent of the parties and economic effect of the Terms and Conditions.

(28.) WARRANTY DISCLAIMER. YOU AGREE THAT YOUR USE OF THE GREENSBURGNEIGHBORS.COM WEBSITE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, GREENSBURGNEIGHBORS.COM, ITS MODERATOR, OWNERS, OPERATORS, OFFICERS, EMPLOYEES, AFFILIATES, AND/OR LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE WEBSITE AND YOUR USE THEREOF. GREENSBURGNEIGHBORS.COM MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THIS WEBSITE'S CONTENT OR THE CONTENT OF ANY SITES LINKED TO THIS SITE AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF GREENSBURGNEIGHBORS.COM WEBSITE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THIS WEBSITE, (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THIS WEBSITE BY ANY THIRD PARTY, AND/OR (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE GREENSBURGNEIGHBORS.COM WEBSITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. (29.) Limitation of Liability. GREENSBURGNEIGHBORS.COM is not responsible for the intentionally tortuous or criminal acts of any third party. In no event shall GREENSBURGNEIGHBORS.COM, its Site Director, owners, operators, officers, employees, affiliates, and/or licensors, be liable to You for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (i) errors, mistakes, or inaccuracies of content, (ii) personal injury or property damage, of any nature whatsoever, resulting from Your access to and use of GREENSBURGNEIGHBORS.COM Website, (iii) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (iv) any interruption or cessation of transmission to or from this Website, (v) any bugs, viruses, Trojan horses, or the like which may be transmitted to or through this Website by any third party, and/or (vi) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the GREENSBURGNEIGHBORS.COM Website, whether based on warranty, contract, tort, or any other legal theory, and whether or not the company is advised of the possibility of such damages. To the maximum extent permitted by law, GREENSBURGNEIGHBORS.COM is not responsible for and specifically excludes special, incidental and consequential damages resulting from any breach of warranty or condition, or under any other legal theory, including but not limited to loss of revenue; loss of actual or anticipated, loss of the use of money; loss of anticipated savings; loss of business; loss of opportunity; loss of goodwill; loss of reputation; loss of, damage to, or corruption of data; or any indirect or consequential loss or damage howsoever caused including any costs of recovering, programming, or restoring and program or data stored or used with supported products and any failure to maintain the confidentiality of data stored on supported products. GREENSBURGNEIGHBORS.COM specifically does not represent that it will be able to resolve any support issues under these Terms and Conditions without risk to or loss of the programs or data. GREENSBURGNEIGHBORS.COM's liability for any and all damage shall in no event exceed the payments received by GREENSBURGNEIGHBORS.COM for the contract provided pursuant to these Terms and Conditions. The remedies set forth herein shall be at the User's sole and exclusive remedies for any breach by GREENSBURGNEIGHBORS.COM under these Terms and Conditions.

(30.) Prosecution of Boneheads. If GREENSBURGNEIGHBORS.COM finds that a User has intentionally and willfully breached these Terms and Conditions, GREENSBURGNEIGHBORS.COM shall prosecute each Bonehead using all applicable local, state and federal. Such prosecution shall be filed within the state of Indiana.

RESPONSIBILITIES OF GreensburgNeighbors.Com

(1.) GREENSBURGNEIGHBORS.COM agrees to post Advertising Rate changes 7 days prior to the effective date of change on its sites. GREENSBURGNEIGHBORS.COM reserves the right to suspend site usage during the change of rates.

(2.) GREENSBURGNEIGHBORS.COM agrees not to sell or distribute Your account information, including Your email address, to any third party for the purposes of unsolicited contact.

(3.) GREENSBURGNEIGHBORS.COM will use reasonable efforts to respond to all requests for information during normal hours of operation, excluding holidays.

(4.) GREENSBURGNEIGHBORS.COM agrees to cancel or erase User Content, Advertisement and/or Ad Campaign at the request only of the User. User must verify their account name and password. Credit for Content space purchased will not be provided for any circumstance.

(5.) GREENSBURGNEIGHBORS.COM agrees to notify Users through their Accounts of any changes to these Terms and Conditions 7 days prior to the effective date of change on its sites. GREENSBURGNEIGHBORS.COM reserves the right to alter these Terms and Conditions at any time.

(6.) GREENSBURGNEIGHBORS.COM agrees to use its best efforts to eliminate Boneheads and User Content in violation of these Terms and Conditions from the Website. You acknowledge and agree that GREENSBURGNEIGHBORS.COM cannot eliminate 100% of the Bonehead(s) from the Website.
